SECTION: I
Time-bar (1 month)
Refund claim must be received within 1 month from the date of exportation of the goods. Municipal Commissioner is empowered to condone delay of any longer period (Rule 11) condonation of -i) Delay upto 3 months over and above 1 month in respect of export by Road, Rail or Air. 20% subject to maximum of Rs.10000/- per claim.
ii) Delay upto 45 days over and above 1 month in respect of Export by Sea & Rs.10/- per claim.
Delay from 46 days to 3 months over and above 1 month in respect of export by sea.20% subject to maximum of Rs.10000/- per claim.
Such other cases other than mentioned in (i) &
(ii) may be referred to Municipal Commissioner for Condonation of delay.

7. IMPORTER & EXPORTER DIFFERENT
In case of custom House Agents appears as Exporter on behalf of Importer on export notes are to be treated as same with. Rs.10/- per ‘B’ form or Export Note.
8. In other cases the name of the importer in the ‘B’ Form may be corrected after verifying invoice, challan, packing-list, bill of entry, Bill of Lading, Transport Receipt, Freight Receipt, Cash Memo & Delivery Note, Gate Pass, Goods Consignment Note, Lorry receipt, Acknowledgements on the Lorry or Transport receipt by the owner of the goods and any documents where there are reasons to believe the correctness of the names of the importers. Rs.10/- per ‘B’ Form or Export Note.
9. DIFFERENCE OF 10 PER CENT BETWEEN WEIGHT
To be condoned with and to allow refund on the lowest weight where refund is to be calculated on the weight basis. 20% fee.
10. In case where refund is calculated on valuation basis refund to be allowed with a fee of. Rs.10/- per export note.
EXPORT of the goods without Municipal Examination at the place of export
11. The failure to offer the goods for Municipal Examination is to be condoned with. 15% fee covered by export note in case of export by Rail or Sea.
Remark.
There is material evidence viz. Railways & B.P.T. ‘s cft. To indicate export of the goods.
12. Export by road (not offered for Municipal Examination) normally to be rejected in exceptional circumstances, a penalty of. 25% fee. * *Remark Subject to verification of the transport receipt and production of a letter from the consignee confirming the receipt of the goods.
13. Export by Air (note offered for Municipal Examination) normally to be rejected, in exceptional circumstances, a penalty of (Ref: Minutes of meeting of 08.12.1989) 15% fee per export note in case of export by Air subject to verification of Air Way Bill. * Remark: Subject to verification of Air Way Bill.
14. Omission of exporter’s signature in exports notes – (either in one or both) to be condoned with. 20% fee per export note.
15. Omission of Exporter’s name in exports notes (either in one or both) to be condoned with. Fee of Rs.10/- per export note.
Omission of consignee’s full postal address on export note. Rs.25/- per export note. Remark : Minor discrepancy.
16. Omission of Exporter’s signature or name in ‘E’ forms and ‘D’ forms (either in one or all) to be condoned with - Fee of Rs.10/- per claim.
17. Stamping of Municipal Marka on Goods.
Failure on the part of the importer to get the articles shown in appendix B of the Octroi Rules duly stamped with Municipal Marks is to be condoned with. 25% fee.
18. Registration of exports notes
The export note is required to be registered before the goods are brought in shed or Docks otherwise refund is not admissible. However, the delay maybe condoned.
i) Delay of one day. With no fee.
ii) Delay from 2 days to 15 days. 20% fee.
19. Repacking of the goods without Municipal Supervision
i) Failure on the part of the exporter to obtain municipal supervision for repacking of the goods before their export. 25% fee.
ii) Refund claims in respect of liquid articles imported loose and in bulk quantities and exported also loose and in bulk quantities. To be processed with a fee of – (for repacking). 5% fee.
iii) If repacking is done at the instance of the Customs authorities and refund is claimed. Claim is to be processed without any free as per M.C.’s sanction under No.MGC/B/6939 dt.26.3.93.
20. Discrepancies in respect of the goods marked with Municipal Marks.
a) Refund in respect of the cases with Municipal marks other than the declared in export notes may be condoned with.20% fee.
b) Refund in respect of cases where municipal marks obtained but not declared at the time of export also considered for refund with. 20% fee.
c) Refund in respect of the cases which are examined by the Inspector but marks not seen may also be allowed (by debiting the cases in the import bills bearing the Municipal Marks declared in the export notes). 20% fee per export note.
21. Minor discrepancies in Export Notes and ‘B’ Form Condo nation of omission and discrepancy in export note in respect of -
i) Any column remained to be filled in, in export note or ‘B’ Form. Rs.5/- per column.
ii) Commander’s name and Shipping Bill No. and date in ‘C’ Form. Rs.5/- per ‘C’Form.
iii) Omission of work ‘per case’ or ‘per kg.’Rs.5/- per
export note.
iv) In case of goods for which stamping is obtained the omission of import route in the export note to be condoned with No fee.
22. Minor discrepancies in ‘E’ Form.
Any column remained to be filled in, either in one or both ‘E’ Forms, the same is condoned with.Fee of Rs.10/- per column.
23. Minor discrepancies in ‘D’ Form.
Any column remained to be filled in, on reverse side of ‘D’ Form, the same is condoned with.Fee of Rs.10/- per column.
24. Unauthorised changes in the documents.
The unauthorized changes which are made in the original export notes or in the ‘B’ Form after receipt of the same duly certified from Octroi staff will be liable for rejection of the claim. However, any Unauthorised changes before receipt of both the documents from Octroi staff, the discrepancy will be condoned with - 20% fee per export note or per ‘B’ Form.
25. As regards the minor discrepancies such as difference in the description of goods etc., if noticed in the refund claims or the ‘B’ Form other than those mentioned above may be condoned by Dy. A. & C. (Octroi) provided such discrepancies do not involve rejection of refund of Octroi with a fee of. Rs.5/- per discrepancy
26. If a claim is lodged in advance after the date of registration of export note, Weighment and examination, but before the date of shipment /loading in case of export by Sea or Rail, the claim may be passed with a fee of - 20% fee.
Revision of fees sanctioned by Addl. Municipal Commissioner (Bh) under No.AMC/BH/D/7316 of 16.4.94. The fees mentioned herein are applicable to export refund claim lodged on or after 16.8.1994, so far as they relate to such claims.
